Work authorization for Permanencia Transitoria permit holders

To whom is this permit directed?

The holders of a Permanencia Transitoria permit will not be able to engage in remunerated activities.

Exceptionally, you may apply to the Servicio Nacional de Migraciones (SERMIG) for authorization to engage in specific and occasional activities as personnel of public shows, sports events, lecturers, consultants, or technical experts, for which you will receive remuneration or economic benefits in Chile or abroad.

You may also engage in remunerated activities if you enter as an inhabitant of a border zone, only if the bilateral agreement with the bordering country so establishes.*

This authorization will be subject to the payment of fees, except for those cases typified in Article 51 of Law No. 21.325 of Migración y Extranjería.

Where do I apply for this work authorization?

The application for Work Authorization for holders of Permanencia Transitoria is made through the Portal de Trámites Digitales of SERMIG, by entering with ClaveÚnica or with the account created by the applicant, the legal representative or employer for such purposes.

Important:

You must apply at least one business day prior to the start of your remunerated activities and during working hours (Monday to Thursday from 8:00 a.m. to 5:00 p.m. and Friday from 8:00 a.m. to 4:00 p.m., Chilean time). Otherwise, your application will be effective the next business day.

* Spanish only. It can be applied before or after entering Chile.

Requirements

  1. Valid identity document: an image of the identification page with which you made or will make entry to the country [passport, Cédula de Identidad (identity card), DNI (national identity card), etc.] where your identification information, number, date of birth, date of issue and expiration date are legible. In case of entering with DNI or Cédula de Identidad, you must upload the image of both sides of the document.
  2. Permanencia Transitoria Visa permit or prior authorization if applicable.
  3. Tarjeta Única Migratoria (TUM) where your identification information and date of entry to the country or entry stamp to the country in your passport are legible (*).
  4. Notarized letter from a Chilean company or employment contract from a Chilean company, signed by both parties, legalized with the company with which you require authorization to engage in remunerated activities, with the following information:
    • Individualization of both parties.
    • Specification of functions and place of work.
    • Specific dates for which you are applying for the Work Permit (from-to).
    • Include a clause indicating the following:
      “La obligación de prestar servicios emanada del presente contrato, sólo podrá cumplirse una vez que el trabajador haya obtenido la autorización especial para realizar actividades remuneradas en Chile”
      (The obligation to work under this contract may only be fulfilled once the worker has obtained the special authorization to engage in remunerated activities in Chile).
    • Payment of fees when applicable.

(*) In case the applicant is applying for the permit within Chile.

  1. Valid identity document: an image of the identification page with which you entered the country [passport, Cédula de Identidad, DNI, etc.] where your identification information, number, date of birth, date of issue and expiration date are legible.   2. Permanencia Transitoria Visa permit or prior authorization if applicable.
  3. Tarjeta Única Migratoria (TUM), where your identification information and date of entry to the country or entry stamp to the country in your passport are legible (*).
  4. Copy of a valid Work Permit.
  5. Document signed in the presence of a notary public attesting to the validity and continuity of your work, as stipulated in the valid Work Permit:
    • Individualize both parties.
    • Specify functions and place of work.
    • Specific dates for which you are applying for the Work Permit (from-to).
    • Payment of fees when applicable.

General information

Yes, you can extend your Autorización de Trabajo (Work Authorization), as long as your Permanencia Transitoria permit is still valid. The extension must not exceed this term.

The authorization to engage in remunerated activities will be subject to the payment of fees, which can be paid either before or after your entry to Chile. The payment will be requested through the Portal de Trámites Digitales of SERMIG when you request the authorization.

If you engage in remunerated activities without SERMIG's authorization or approval, you will be sanctioned with an average fine of five Unidades Tributarias Mensuales, regardless of the cause for expulsion referred to recurrence in this conduct, established in Article 127 No. 5 of Law No. 21.325.
